This brief study aims to search for the historical origins of said resource both in the civil process (in Las Partidas and in the New Compilation) and in the labor process (the Consolidated Text of the Labor Procedure Law). At the same time, the problems that this resource presents in the labor process are analyzed, both from the perspective of scientific doctrine and from case law (Supreme Court and Constitutional Court), as a consequence of not having an ordinary resource (complaint is the only one of this nature) and the limitations of the labor process, which is why “de lege ferenda” proposals are proposed.

Received: 26.03.2024
Accepted: 10.09.2024

PDF and HTML corr.: 13/01/2025
DOI in the footer: <https://doi.org/10.18543/ed.3206> instead of <https://doi.org/10.18543/ed.3104>.
2024-12-23T08:36:35+01:00 Copyright (c) 2024 University of Deusto https://revista-estudios.revistas.deusto.es/article/view/3206 The public direction of government centers: advising or co-presidency? The main research question of the study is to understand the recruitment process of individuals who have held the position from 1946 to 2024. To achieve this, a database was constructed with the profiles of the 31 heads of the U.S. center of government, analyzing the influence of territorial factors related to the person who holds the presidency, educational background, and professional experience in their recruitment. The study finds that the position is not attractive to individuals with long political careers and that it does not significantly promote subsequent political careers due to its high turnover rate.

Received: 11.07.2024
Accepted: 22.10.2024
2024-12-23T08:40:17+01:00 Copyright (c) 2024 University of Deusto https://revista-estudios.revistas.deusto.es/article/view/3208 Decentralisation of personal wealth taxation in the light of constitucional principles of redistribution 2025-01-21T09:03:36+01:00 Pedro García Guijarro revistaestudios@deusto.es
Tax decentralization plays an essential role in the consolidation of the financial autonomy of the Autonomous Communities, as a material presupposition of their political autonomy. Through this decentralization, the State has ceded the collection, management and regulatory powers over some taxes, including personal wealth taxes: the Wealth Tax and the Inheritance and Gift Tax. However, recently there have appeared numerous investigations that warn about the negative effects over the redistribution of wealth that can derive from the autonomic cession of this type of taxes. In this paper we propose a constitutional review of the decentralization of personal wealth taxes, contrasting it with the principles and mandates of redistribution established in our Constitution.

Received: 26.03.2024
Accepted: 16.06.2024

PDF and HTML corr.: 13/01/2025
DOI in the footer: <https://doi.org/10.18543/ed.3206> instead of <https://doi.org/10.18543/ed.3104>.
2024-12-23T08:41:34+01:00 Copyright (c) 2024 University of Deusto https://revista-estudios.revistas.deusto.es/article/view/3209 Analysis of the special forms of execution existing in the Spanish penitentiary system for maternal and paternal profiles: possibilities, criticisms, proposals for improvement and defense of an extensive application to fathers of the normative possibiliti 2025-01-21T09:04:37+01:00 Tàlia González Collantes revistaestudios@deusto.es
This work addresses the complex problem of the incarceration of people who have dependent children, suffered especially by women, and the impact that this has on minors and on intra-family dynamics. The different ways of serving the prison sentence in these cases are explored from a critical perspective, and it is defended that when making decisions about any aspect of detention, the care responsibilities of these boys and girls should be taken into account, avoiding the separation of mothers or fathers and their children and, also, their entry into a penitentiary establishment, at least one with an ordinary regime. The first of these generations corresponds to fundamental rights, which can be demanded immediately as the minimum necessary for the subsistence of any person. Thus, and as a disruptive innovation, this higher standard enshrines love as a fundamental right for boys and girls. However, its indeterminate nature prevents full materialization through constitutional actions, since it is not possible to force someone to love another person. Consequently, this article delimits the theoretical scope of this right as a constitutional principle and value, which can only be materialized through other rights according to each of the realities from and to which it is applicable.

Received: 04.08.2024
Accepted: 25.10.2024

PDF and HTML corr.: 13/01/2025
DOI in the footer: <https://doi.org/10.18543/ed.3206> instead of <https://doi.org/10.18543/ed.3104>.
2024-12-23T08:46:05+01:00 Copyright (c) 2024 University of Deusto https://revista-estudios.revistas.deusto.es/article/view/3212 Historical and competential evolution of the island councils in the Canary Islands 2025-01-21T09:12:33+01:00 Florentino De Guzmán Plasencia Medina revistaestudios@deusto.es
This article analyzes the historical evolution of the island councils in the Canary Islands and the competencies assigned to local administration. To this end, we first analyze how today Europe, in terms of rights and freedoms, identifies itself in law as a distinct space in the global context. It then deals with the diverse configuration and legal recognition of rights in the European space, as well as the nature with which national and European courts act in their guarantee. We then study how the previous configuration of rights and freedoms is related to the courts in Europe, and in this light we also examine the divergences between rights and courts that can be seen in the different legal systems and which create dissonance in the European space of rights. And finally, we will dedicate some considerations with which to reduce such divergences and dissonances.

Received: 22.11.2024
Accepted: 28.11.2024

PDF and HTML corr.: 13/01/2025
DOI in the footer: <https://doi.org/10.18543/ed.3206> instead of <https://doi.org/10.18543/ed.3104>.
2024-12-23T08:53:37+01:00 Copyright (c) 2024 University of Deusto https://revista-estudios.revistas.deusto.es/article/view/3216 Dynamics of change in the management of the Royal Household and the development of the King’s functions 2025-01-21T09:21:56+01:00 Daniel del Valle-Inclán Rodríguez de Miñón revistaestudios@deusto.es
Law 19/2013 subjects the Royal Household to the obligations of transparency, without its provisions having been considered unconstitutional. Since then, the strategic communication of the Royal House is more proactive now and tries to show an image of transparency and correct management. Concepts such as “honesty, economic transparency, closeness and modernization” are key in this new stage. However, communicating is not the same as informing and herein lies one of the aspects analysed in this work, taking as reference the aforementioned Law of Transparency, Access to Public Information and Good Government, and the work carried out through the website of the Royal House. Furthermore, it is suggested that it can be clamped with the endorsement as a tool to guarantee the Monarch’s conduct in those areas for which it is necessary. It critically examines the EU Staff Regulations and their provisions for whistleblowers, contrasting them with the broader protection framework established by Directive 2019/1937. The analysis highlights the fragmented nature of protections available to EU civil servants compared to national frameworks, emphasizing the legislative gaps and enforcement challenges. Special attention is given to Frontex due to its significant relation with fundamental rights and transparency, evaluating its internal mechanisms and systemic deficiencies. The analysis addresses the tension between Regulation Brussels I bis article 25(1) and the Spanish Maritime Navigation Act (MNA) articles 251 and 468, which impose additional validity requirements. The essay evaluates the European Court of Justice’s recent ruling in joined cases C-345/22 to C-347/22, clarifying how to determine the applicability of jurisdiction clauses against a third-party holder of the bill-of lading and explaining that the Spanish additional requirement of individual and separate negotiation of the clauses is not applicable when Regulation Brussels I applies. The unique characteristics of sports policy within the European Union, as defined by the legal framework established in the Treaty of Lisbon adopted in 2007, are notable, given the multifaceted nature of the subject. Key issues such as the free movement of persons, competition rules, and labor development conditions are among the matters we aim to address herein. In particular, the recent judgment of the Court of Justice of the European Union in FIFA v. L. Diarra (Case C-650/22), resolved through a preliminary ruling referred by the Court of Appeal of Mons (Belgium), provides an opportunity for a detailed analysis.

PDF and HTML corr.: 13/01/2025
DOI in the footer: <https://doi.org/10.18543/ed.3206> instead of <https://doi.org/10.18543/ed.3104>.

PDF and HTML corr.: 13/01/2025
DOI in the footer: <https://doi.org/10.18543/ed.3206> instead of <https://doi.org/10.18543/ed.3104>.
2024-12-23T09:07:36+01:00 Copyright (c) 2024 University of Deusto
