The control of parliamentary activity as a guarantee of the constitutional system

Abstract

Parliamentary control is the essential nucleus of the constitutional State, within a system of surveillance, evaluation and supervision of the government’s action. This research denounces the contradictions of the control systems in a new interpretation of the «acta interna corporis», exposing the axiological differences of the rights of parliamentarians. In addition, it is studied how the guarantor role that Parliament must adopt is produced, from a Comparative Law perspective, within the proposals made by other legal systems. To carry out this study, a review of the jurisprudence of the Constitutional Court has been carried out, with special attention to conflicts with control instruments.
