Freedom of speech and the Case Law of the Court of Justice of the European Union

Abstract

Article 11 of the Charter of Fundamental Rights officially inserts freedom of expression in the scope of European Union Law. But this freedom was a European fundamental right already, as a part of the common constitutional traditions of the member states and also through article 10 of the European Convention of Human Rights. At EU level, freedom of expression has been mixed up with economic freedoms and competition law, as well as with regulations on audiovisual communications, on data protection, on intelectual property rights and on electronic commerce. This article analyses the situation of freedom of expression in such regulatory framework and in the case law of the European Court of Justice.
