The fragility of the fundamental right to the protection of minors’ personal data when faced with the exposure of their personal and family life on the internet: The need for new mechanisms and legal safeguards
Abstract
The legal protection of minors when parents share their personal data on social networks is a challenge for 21st century law. The current immersion in the Information Society encourages people to share, with increasing frequency, aspects of their private lives on these online platforms. In this new context, we notice the existence of a certain number of parents who are influencers whose professional activity consists of sharing –with global reach– on the Internet and social networks fragments of their lives in order to promote products and services, or rather, a large number of them expose the lives of their minor children in exchange for a certain economic benefit; furthermore, it is worth noting that a certain number of parents allow the minor to carry out this occupation. This being the case, we wonder whether the legal system contemplates mechanisms to protect minors and safeguard their rights in the event that the parents do not act in the best interests of the minor.
