The Regulation of Social Housing and the adaptation of the Legislation to the European context

Abstract

In the European Union, the European Parliament has supported the protection of the right to housing as a fundamental right, as well as the access to social housing. However, there is not a unique definition of social housing in the European Union. This article analyses the measures regarding social housing that have been established in the new law for the right to housing, relating them to social housing as a right and social housing in the European Union, making a brief comparison with the social housing system in some member States of the Union. The article analyses also the provisions relating to evictions from the point of view of international law obligations in Spain. The aim of this article is to assess the changes that the law has introduced regarding these specific points of the problematic in relation to housing. It is concluded that progress must be made in the conception of social housing as rented housing and in the understanding that the problem of the access to housing is not limited only to the groups considered as disadvantaged.
