The constitutional status of social rights in Spain

Abstract

The Welfare State can be defined as a form of government that involves a responsability of the public powers in order to ensure social protection and basic welfare for citizens. It is characterized for pursuing effective equality among citizens and providing them with economic security and social servicies.

The social rights are the result of the labor movement in the industrialized states during the second half of the nineteenth century. Among others, include these rights: the right to education, the right to private property, labor rights and freedom of enterprise. Furthermore, are guided by some principles: the principle of protection of the family, the principle of integral protection of children, the principle of protection of workers, the right to heatlh protection…

In addition to making a sustained study of these social rights, this paper aims to expose the reforms that should be operated in the Constitución in this regard.
