Abstract

This paper deals with the relationship between jurisdictional function and ADR. In particular, it focuses on potential conflicts between mandatory mediation, right to effective judicial protection and other principles and rights that draft our legal system. It pays particular attention to the articles 24.1 CE and 47 CDFUE, and also to the TC and the ECJ jurisprudence.
