Rule of Law, judicial independence and autonomy of the Public Prosecutor’s Office. Towards a European model of prosecution

Abstract

In the European Union, the Public Prosecutor’s Office is a common institution, but of disparate configuration. The importance of its role and its prominence in the European legal area has raised concerns about the risk that its action is more attentive to governmental interests than to the promotion of justice in defense of legality. We are immersed in a process of convergence of the different models of prosecutor’s office in order to strengthen their autonomy and objectivity and we are witnessing important national reforms. The goal is to increase mutual trust in the functioning of the most respected national criminal justice systems and to strengthen our commitment to the values of the rule of law, pillars of national systems and of the European Union itself.
