Home schooling and Constitution. Some considerations on a prudent constitutional case law

Abstract

This paper addresses from a constitutional perspective the problem of home schooling. To do this, first be raised in general terms the problems that this practice of educating children outside the school presents from a legal point of view. Subsequently, we consider the recent judicial response that the Spanish Constitutional Court has given to the claim of parents to exempt their children from fulfilling their duty of schooling. Finally, we assess the possibility of providing this option through a reform of the educational legislation.
