Housing as a fundamental right. International commitments beyond the governing principle

Abstract

The main objective of this paper is to verify that, despite the fact that the right to housing has been enshrined in our Constitution as a governing principle of the Economic and Social Policy, the international obligations that Spain, after the ratification of the revised European Social Charter and the International Covenant on Economic, Social and Cultural Rights and the assumption of their control systems, has given a new meaning to the right established in Article 47 of the Spanish Constitution, giving it greater binding force and, above all, greater guarantees. This analysis of the fundamental right to housing cannot be separated from the principle of the indivisibility of human rights and the respect for the human dignity, which are the central axes of the study.
