Constitutional implications of the guiding principles on human rights and business

Abstract

A decade has passed since the adoption of the Ruggie Principles of UN. Consequently, we can evaluate if their internal development in companies has affected the traditional constitutional systems of Human Rights protection. The outcomes will allow us to analyze the resulting social situation (nationally and internationally), and it will help us to determine whether constitutional bases on respect and protection of HR have been established, as expected, to order the transnational relationship between citizens and the economic power; or if, on the contrary, we continue searching for a framework accepted by all, for the governance of globalization.
