Ecological transition and the intergenerational human right to a healthy and sustainable environment as a guarantee

Abstract

The ecological transition entails a reconfiguration of the socioeconomic, political and legal systems of States and the international community in a way that harmonizes human activities with the ecological limits of planet Earth. In the face of the triple planetary crisis – pollution, climate change, and biodiversity loss–, the responses must be diverse, but they all must consider the human rights, particularly those of the most vulnerable individuals, communities, and peoples. In this regard, the process of recognizing the human right to a healthy and sustainable environment –including the right to climate and the right of Nature–, can contribute to ensuring that this transition leads to a sustainable future for humanity, such that present actions do not compromise the ability of future generations to meet their own needs and exercise their rights.
