Analysis of directive (EU) 2024/1785 on industrial emissions and its projection in Digital Environmental Law and in Law 5/2013

Abstract

This article analyzes Directive (EU) 2024/1785 on industrial emissions, examining its legal structure, regulatory objectives, and key innovations. It highlights the digitalization of environmental governance, along with the integration of the circular economy and decarbonization as cornerstones of the new control model. The article also addresses the Aarhus Dimension of the Directive, which strengthens transparency, public participation, and access to justice as pillars of democratic environmental governance. From a public law perspective, it argues that the Directive lays the groundwork for an emerging European digital environmental law. Given the emerging nature of this legal category, the article explicitly acknowledges the initial state of digital environmental law and proposes a first systematization of its elements already enshrined in Directive (EU) 2024/1785, based on electronic permit management, database interoperability, and active real-time transparency, in line with the European Declaration on Digital Rights and Principles for the Digital Decade. In the Spanish context, its repercussions on Law 5/2013 and the integrated environmental authorization regime are analyzed, identifying the challenges for its adaptation and proposing criteria and legislative reforms that harmonize the national regulations with the new European standards.
