Constitutionalising Artificial Intelligence

Abstract

This work addresses the need to integrate artificial intelligence into constitutional law through its constitutionalisation. In this regard, it first analyses the different dimensions of artificial intelligence and then specifies how these dimensions affect constitutional law in material, formal and contextual terms. Next, it analyses the dual consideration of artificial intelligence as an instrument and a factor of power, and under its auspices, the new paradigms from which to constitutionally address artificial intelligence. Finally, it presents a potential proposal for the constitutionalisation of artificial intelligence.
