Abstract

The objective of this paper is to analyze the main litigation and advisory laws and jurisprudence of the Inter-American Human Rights System, regarding the protection of the right to a healthy environment, in the light of the first Advisory Opinion (OC- 23/17) issued by the Inter-American Court of Human Rights about the environment, in order to identify the scope and state limits that international law has imposed on the American States in this area.
