Abstract

Spain is experiencing a situation of political instability with Catalonia, whichhas led to the granting of pardons to the prisoners in the process. This fact has supposed a turn in the national panorama, not only from the political point of view but from the legal point of view, due to the fact that the Supreme Court has opposed in the report that it issued before its concession, a procedure that the Pardon Law establishes, to its concession. Faced with this conflict between two of the three powers of the State, it has raised alarms about what role the King of Spain should have played. And it is that, the King in the faculty that is granted to him in the Spanish Constitution, as a symbol of the unity and permanence of Spain, could he have opposed exercising the prerogative of the royal right of grace?
