Sexual Violence as an International Crime in the Russian-Ukrainian Conflict, 2014-2022

Abstract

Through this article the authors seek to analyze the sexual violence in the context of the Russian-Ukrainian conflict between 2014 and 2022, through the review of the reports of the Office of the United Nations High Commissioner for Human Rights, the United Nations General Secretariat and, the Independent International Commission of Inquiry on Ukraine, making a comparison with the Statute of the International Criminal Court and relevant decisions of the international jurisprudence. Based on this, a prospective analysis of accountability and access to justice for victims is made, identifying the existence of de jure and de facto limitations at the national and international levels that hinder the punishment of crimes of sexual violence committed in the Russian-Ukrainian conflict.
