Changes in the international concept of Constitutional State in a context of global penal justice

Abstract

In these pages we face a classical topic from a new approach: the concept of constitutional State under International Law where the power inherent to sovereignty are to be exercised at the same level than the imperative duties for States to prosecute and punish those authors of international crimes. Under this approach, it is defended the thesis that the concept of constitutional state worldwide postulated in the latest years is based upon a three-pillar-idea of legitimacy, intangibility and accountability.
