Abstract

Amid growing concern over the prevention of environmental damage, the proper configuration of reparation emerges as one of the most significant challenges. This paper analyzes the criminal treatment of reparation under the Spanish Criminal Law, focusing on Articles 339 and 340 of the penal code, both from a doctrinal perspective and through a jurisprudential review that provides a practical outlook on their application. It also examines the impact of the recent EU Directive 2024/1203, which strengthens obligations regarding restoration and reparation, raising potential adjustments in Spanish legislation.
