Inclusion of women in strategic public procurement: an emerging policy in Colombia

Abstract

In recent years, the Colombian legal system has embraced the strategic public procurement model. In applying this paradigm, it has reinforced the inclusion of women through procedural incentives and during contract execution. The objective of this paper is to determine the scope of this horizontal policy for the public procurement system. To this purpose, the article explains the concept of social clauses and positive discrimination in favor of women as an expression of constitutional effectiveness. It also details affirmative actions in favor of the female population in public procurement. Finally, it highlights the necessary proportionality of these measures so as not to affect the equality and free competition of other actors or the quality of the contractual object.
