Dark Patterns: Challenges for Peruvian Consumer Law in the Digital Era

Abstract

E-commerce in Peru has transformed consumer relations, introducing new risks for users. Among these, dark patterns stand out as digital design strategies that manipulate decision-making through cognitive biases, undermining consumer autonomy and the right to information. This article, adopting a dogmatic and comparative legal approach, examines the regulatory gaps within the Peruvian framework regarding these practices and the limitations of their effective enforcement. Drawing on experiences from the European Union, the United States, and Chile, it proposes a normative definition of dark patterns and identifies key regulatory challenges.
