Fundamental rights of the military staff boarded for the compliance of an international mission

Abstract

The study of the fundamental rights and its warranty is a matter of the Constitutional Right. In this sense, the analisis of the warranty’s level and the development of the constitutional rights of different groups like, for example, the inmigrants, the minorities and the women, has turned into an appellant subject of the Public Right’s experts. However, the investigation of the implementation’s level in certain concrete fields, like the case of the posibilities of enjoyment of the fundamental rights for the members of the Army in certain particular situations is not a matter studied in full. This work tries to put into effect a brief introduction about the form of realization of the fundamental rights in as a special situation as the one that cause the boarding of the crew and the military staff for the compliance of a mission in international waters.
