The Brüstle judgement on embryos: many merits... and many flaws

Abstract

In this paper there is an analysis of the judgment Brüstle, pointing out the main conclusions reached by the European Court of Justice and makes important considerations regarding the use of certain embryos for scientific research and if its production of simple part of pluripotent stem cells can be subject to patents for industrial and commercial.
