Abstract
El principio de independencia judicial es una cuestión que se aborda con frecuencia en la doctrina constitucional y procesal. Nuestra historia constitucional demuestra que este fue un asunto ampliamente debatido durante los diversos procesos constituyentes del siglo XIX y XX, con posiciones antagónicas. A pesar de ser una constante en el estudio de los juristas, en la actualidad resulta especialmente relevante. El bloqueo en la renovación del Consejo General del Poder Judicial durante los últimos cinco años nos lleva a replantearnos qué significa realmente la independencia judicial, si su configuración constitucional y legal es suficiente y si los mecanismos existentes en nuestro estado de derecho garantizan su adecuada aplicación. La creciente preocupación por el cumplimiento de este importante principio se extiende por toda Europa. La Comisión de Venecia y el Consejo de Europa han expresado esta inquietud en sus informes y publicaciones a lo largo de los últimos años. En este contexto, el proyecto de investigación «Unidad e independencia del poder judicial en el constitucionalismo actual», cuyo título no deja lugar a dudas, busca reflexionar sobre las problemáticas y las dificultades que rodean al poder judicial y a su independencia.
